These Terms and Conditions apply to bookings, photography sessions, image orders, digital products, printed products, and related services provided by Team Sports Image through teamsportsimage.com.au and associated ordering links, forms, galleries, and communications.

By booking a photography session, placing an order, submitting information, attending a photo day, or using this website, you agree to these Terms and Conditions.

1. About Team Sports Image

Team Sports Image provides sports photography services for clubs, schools, associations, teams, athletes, families, and related organisations. Services may include club photography days, team and individual portraits, digital image preparation, retouching, printed products, digital downloads, promotional images, and related design or production work.

2. Bookings and Quotes

Bookings are subject to availability and are not confirmed until Team Sports Image has accepted the booking in writing or otherwise confirmed the photography date with the relevant club, school, association, organisation, or authorised representative.

Any quote, estimate, package information, or product information provided by Team Sports Image is based on the information available at the time. Pricing, inclusions, production requirements, and delivery details may be adjusted if the scope of work changes, if additional services are requested, or if information supplied to Team Sports Image is incomplete or inaccurate.

3. Club and Organisation Responsibilities

Where a photography session is arranged through a club, school, association, or organisation, that organisation is responsible for coordinating reasonable access, timing, participant communication, location requirements, and any information needed by Team Sports Image to complete the work.

The organisation is also responsible for advising Team Sports Image of any known restrictions that may affect photography, including venue rules, safety requirements, access limitations, child safety requirements, or participants who must not be photographed.

3A. Photography Style, Club Preferences and References

If the Club has reference images or examples showing the photography or design style it would like Team Sports Image to consider, those references must be supplied to Team Sports Image before photography planning proceeds.

If no references are supplied, Team Sports Image will determine the photography style, composition and presentation using the Club’s website, available branding, venue and participant requirements, and current photography and design practices as guidance.

Club preferences and supplied references will be considered but cannot guarantee an exact result. The Club acknowledges that Team Sports Image retains final creative and operational discretion over posing, participant spacing, coach placement, composition, framing and the resulting photographic style.

4. Participant Information

Accurate participant names, team details, order information, and other required details must be supplied by the requested deadline. Team Sports Image is not responsible for errors, delays, rework, or incorrect products caused by missing, late, incomplete, or inaccurate information supplied by a club, organisation, parent, guardian, player, customer, or third-party system.

If corrections are required because incorrect information was supplied, Team Sports Image may charge a reasonable fee for additional editing, administration, production, or re-delivery work.

5. Photo Day Attendance

Participants are responsible for attending the scheduled photo session at the requested time, in the requested uniform or clothing, and in a condition suitable for photography. Team Sports Image is not responsible if a participant misses the scheduled session, arrives late, is not ready when called, or is unavailable when the relevant team or group is photographed.

Where practical, Team Sports Image may assist with reasonable catch-up options, but catch-up photography is not guaranteed and may be subject to scheduling, venue access, and additional fees.

6. Orders and Payment

Orders must be placed using the ordering method nominated by Team Sports Image. Payment is required at the time of order unless Team Sports Image has agreed otherwise in writing.

Orders may not proceed to production until payment has been received and the required order details have been supplied. Team Sports Image may cancel, pause, or delay an order if payment is declined, reversed, incomplete, or suspected to be fraudulent.

7. Product Descriptions and Colours

Team Sports Image takes reasonable care to describe products accurately. Product images, previews, sizes, colours, finishes, and examples shown on this website or in ordering systems are indicative only and may vary depending on screen settings, print production processes, materials, cropping, image selection, and supplier availability.

Printed colour and brightness may differ from what appears on a phone, tablet, or computer screen. These differences are a normal part of digital display and print production and are not considered a product fault.

8. Image Selection, Editing, and Retouching

Team Sports Image may select, crop, edit, retouch, composite, colour correct, sharpen, export, and prepare images at its discretion to produce a finished result suitable for the relevant product or service.

Standard editing and retouching is intended to improve presentation while keeping the subject recognisable. Additional editing requests, detailed retouching, re-compositing, object removal, uniform changes, background changes, or other custom work may be declined or quoted separately.

9. Digital Products

Digital products are supplied in the format, size, and resolution nominated by Team Sports Image or described at the time of order. Digital files are supplied for personal use unless Team Sports Image has agreed to a different licence in writing.

Customers are responsible for downloading and safely storing supplied digital files. Team Sports Image may not keep all galleries, downloads, or production files available indefinitely.

10. Printed Products

Printed products are produced using the information and images available at the time of production. Once a printed order has entered production, it may not be possible to cancel or change the order.

If a printed product arrives damaged or contains a production fault, you must contact Team Sports Image within a reasonable time and provide clear photos or details of the issue. Team Sports Image may arrange a replacement, correction, or other reasonable remedy where required.

11. Delivery and Turnaround Times

Any turnaround time provided by Team Sports Image is an estimate only unless expressly confirmed as a guaranteed deadline in writing. Delivery and production times may be affected by order volume, participant data, proofing requirements, supplier delays, courier delays, public holidays, venue access, weather, technical issues, or other circumstances outside the reasonable control of Team Sports Image.

Team Sports Image is not responsible for delivery delays caused by incorrect delivery details, unattended premises, postal or courier issues, or circumstances outside its reasonable control.

12. Refunds, Replacements, and Cancellations

Refunds, replacements, or corrections will be handled in accordance with Australian Consumer Law and any additional rights that cannot legally be excluded.

Change-of-mind refunds are not guaranteed, especially for custom, personalised, digital, edited, downloaded, or printed products. If there is a problem with an order, Team Sports Image should be contacted as soon as possible so the issue can be reviewed.

If a photography booking is cancelled or postponed by a club, school, association, organisation, venue, weather event, emergency, or other circumstance, Team Sports Image may work with the relevant organiser to reschedule where practical. Fees already incurred, production work already completed, or third-party costs may still be payable.

13. Copyright and Intellectual Property

Unless Team Sports Image agrees otherwise in writing, copyright in all photographs, digital files, edited images, designs, templates, artwork, and related materials created by Team Sports Image remains owned by Team Sports Image.

Purchasing a product or digital file does not transfer copyright. Customers receive permission to use purchased images for personal, domestic, and non-commercial purposes, such as printing for personal use, sharing with family, or posting to personal social media accounts, provided the images are not altered in a misleading, offensive, unlawful, or damaging way.

Images must not be sold, licensed, supplied for commercial use, entered into commercial promotions, used in paid advertising, used by a club sponsor, or provided to media or third parties without written permission from Team Sports Image.

14. Promotional Use

Team Sports Image may use selected images for portfolio, website, social media, display, sample product, and promotional purposes unless a relevant restriction has been communicated to Team Sports Image in writing before publication or use.

If you have a concern about a particular image being used for promotional purposes, contact Team Sports Image with the relevant details so the request can be reviewed.

15. Children and Consent

Where participants are under 18, a parent, guardian, club, school, association, or authorised organisation representative may be involved in arranging photography, supplying participant information, placing orders, or communicating restrictions.

Clubs, schools, associations, and organisations are responsible for communicating any known photography restrictions, consent limitations, or child safety requirements to Team Sports Image before the relevant photography session.

16. Privacy

Team Sports Image may collect and use personal information reasonably required to provide photography services, process orders, communicate with customers, deliver products, manage galleries, correct issues, and operate the business.

Personal information may include names, contact details, team details, participant details, order details, delivery details, payment-related information, and images. Team Sports Image will handle personal information in accordance with applicable privacy obligations and any privacy information published on this website.

17. Website Use

You must not use this website, ordering systems, galleries, forms, downloads, or communications in a way that is unlawful, misleading, harmful, abusive, disruptive, or infringes the rights of Team Sports Image or any other person.

Team Sports Image may update, suspend, restrict, or remove access to website content, galleries, forms, ordering links, or downloads at any time where reasonably required.

18. Third-Party Services

Team Sports Image may use third-party platforms, suppliers, payment processors, delivery providers, printing partners, gallery systems, software providers, or communication tools to provide services and fulfil orders.

Team Sports Image is not responsible for the acts, omissions, delays, faults, outages, policies, or terms of third-party providers, except to the extent required by law.

19. Limitation of Liability

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights, guarantees, warranties, or remedies that cannot be excluded under Australian Consumer Law or other applicable laws.

To the extent permitted by law, Team Sports Image is not liable for indirect loss, consequential loss, loss of profit, loss of opportunity, loss of data, reputational loss, or loss caused by circumstances outside its reasonable control.

20. Events Outside Reasonable Control

Team Sports Image is not responsible for failure or delay in providing services or products caused by circumstances outside its reasonable control, including severe weather, illness, injury, venue restrictions, equipment failure, supplier issues, courier delays, technical outages, internet failures, power failures, emergencies, government restrictions, or other events that could not reasonably be prevented.

21. Changes to These Terms

Team Sports Image may update these Terms and Conditions from time to time. The version published on this website at the time of booking, order, or website use will apply unless otherwise required by law.

22. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Where permitted by law, the parties submit to the courts of New South Wales and any courts that may hear appeals from those courts.
